The Role of an Insurance Defense Attorney – What to Know

An insurance defense attorney represents insurance companies in court. They are responsible for defending the insurance company’s interests in cases where the company is accused of negligence or fraud.

These attorneys must be able to investigate claims, interview witnesses, and negotiate settlements. They must communicate effectively with insurance adjusters, claims examiners, and other insurance company representatives.

What Are Their Responsibilities?

Insurance defense attorneys represent parties who have been given legal responsibility for paying for claims made against them. For example, if a doctor is accused of medical malpractice, an insurance company will hire an insurance defense attorney to represent the doctor’s insurance company during the trial.

In cases of dispute with their insurance companies, the policyholders often hire the services of an attorney who specializes in defense. These attorneys help determine whether or not a policyholder’s claim to an insurance company is valid. If the policyholder accuses the insurer of wrongfully denying a claim, the defense attorney will evaluate the claim and local laws to determine its validity. Most importantly, they also ensure that the insurance company complies with state and federal regulations.

What Type of Claims Do Insurance Defense Lawyers Handle?

There are many different types of claims that an insurance defense attorney may handle. These can include the following:

  • Premises Liability
  • Products Liability
  • Property and Homeowners Claims
  • Employment Law
  • Medical Malpractice
  • Legal Malpractice
  • Bad Faith Claims

In each case, the lawyer will work to investigate the claim and build a strong defense against it, which may involve interviewing witnesses, reviewing evidence, and researching the law. Please note that the goal of an insurance defense lawyer is to protect their client’s interests. It may mean working to settle the case out of court or taking it to trial. In either situation, the lawyer will fight to get the best possible result for their client.

Who Do They Represent?

Insurance defense lawyers represent both insurance companies and their customers. For example, an insurance company may have several customers involved in an accident. They would represent GEICO, the insurance company, and the driver with a GEICO policy in court. In this case, the lawyer represents the customer and the insurance company against the injured party in court.

A hypothetical example of this is: Consider the following text: GEICO is a large insurance company that deals with car accidents and property damage. One policy owner was involved in an accident with another person, which damaged the other person’s car. The lawyer will represent both parties in court: GEICO and its customer. The lawyer will protect both parties’ interests in court even if they conflict with each other.

Some only represent insurance companies. An attorney might do this because a policyholder has sued the insurance company because they believe it unfairly denied their claim.

Conclusion

An insurance defense attorney is a critical player in the insurance industry, working to protect the interests of insurance companies and policyholders. They work to investigate and defend against claims of wrongdoing and work to ensure that policyholders receive the coverage they are entitled to.
